General terms of sale

These terms explain what you are buying, at what price, how long it takes to arrive and what you can do if something goes wrong. They apply to every order placed on pkmndistrict.com. We recommend reading them before confirming your cart: by ticking the box provided at checkout, you accept them without reservation.

Version in force since September 2026. The terms applicable to your order are those published on the day you place it.

Article 1. Seller identity

The website pkmndistrict.com is operated by:

Hereinafter, the seller or PKMN District. The buyer, an adult natural person acting for purposes outside their trade or profession, is the customer or consumer. These terms govern exclusively sales to consumers within the meaning of Article 3 of Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Protection of Consumers and Users (hereinafter, TRLGDCU).

Article 2. Products

We sell only factory-sealed Pokémon Trading Card Game products: 36-pack booster boxes, Elite Trainer Boxes, booster packs, bundles, special collections and complete boxes. No single cards, no graded products, no opened or refurbished products.

All items are new, genuine and come from official distribution channels within the European Union. They are sold in their original packaging, with the factory seal intact.

The essential characteristics of each product, namely its edition, format, contents announced by the manufacturer, language and release date, are shown on the product page. Photographs and illustrations are for guidance only: packaging presentation or box artwork may vary depending on the production batch.

The contents of a sealed product are determined at random by the manufacturer. We have no influence over them and guarantee no rarity, no pull and no market value for the cards obtained. Opening a product without getting a specific card does not constitute a defect.

The language of the products is stated on each product page. Unless otherwise stated, products are in English.

Article 3. Prices

Prices are shown in euros, VAT included at the applicable rate. Shipping costs, where applicable, are calculated and shown in the cart before you confirm the order. The total amount payable is summarised on the last screen, before final confirmation.

We may change our prices at any time. The applicable price is the one displayed when you confirm your order.

When we announce a price reduction, the crossed-out price is the lowest price we have applied during the previous thirty days, in accordance with Article 20 of Law 7/1996 on the Regulation of Retail Trade.

In the event of an obvious display error, for example a ridiculously low price or a clear typo, we will inform you without delay and you may cancel your order with a full refund.

Article 4. Purchase process

The process is as follows: selecting items, reviewing the cart, entering the delivery address, choosing the payment method, order summary, acceptance of these terms and confirmation.

Before confirming, you can review the details of your order and correct any errors you notice. We send you an email confirmation summarising the order. The contract is concluded when that confirmation is sent, which constitutes the confirmation on a durable medium required by article 98.7 of the TRLGDCU.

The computer records kept in our systems constitute proof of orders and payments.

To make a purchase you must be of legal age and have sufficient legal capacity. You are responsible for the accuracy of the details you enter, in particular the delivery address and email address.

Article 5. Availability

Our offers are valid while the displayed stock lasts. The quantities shown on product pages reflect our actual stock.

Each item can be ordered up to a maximum of 299 units per order, subject to available stock.

If an item becomes unavailable after your order has been confirmed, we will let you know by email. We will refund the corresponding amount within fourteen calendar days, or you can choose a replacement item if you prefer.

Article 6. Pre-orders

Some items are offered for pre-order before their official release. They are identified as such on the product page, with the release date announced by the manufacturer.

  • Payment is taken when you order and reserves your unit within our allocation.
  • The parcel ships on the official release day, unless the manufacturer postpones it.
  • A mixed cart, with pre-orders and available items, ships in one go on the date of the latest item. If you would rather receive what is already available sooner, place two separate orders.

If the manufacturer postpones the release date, we will notify you by email with the new date. You can keep your pre-order or cancel it and receive a full refund within fourteen calendar days. If the manufacturer cancels the release or our allocation is reduced to the point that we cannot fulfil your order, your pre-order is cancelled and fully refunded within the same period.

The right of withdrawal provided for in Article 10 also applies to pre-orders, and its period starts from receipt of the parcel.

Article 7. Payment

Payment is made in a single charge, in euros, at the time of ordering. Accepted methods are shown on the payment screen: Visa, Mastercard and American Express cards, as well as any other method active at that time.

Transactions are processed by our authorised payment providers, in an encrypted environment compliant with the PCI DSS standard, with strong cardholder authentication (3-D Secure) where required. We never have access to your card number and we do not store it.

The order is only processed once payment has been authorised. If the bank declines it, the order is automatically cancelled.

We may suspend or cancel an order in the event of a payment issue, suspected fraud or an anti-fraud check by our provider. We will notify you by email.

The invoice is attached to the shipping confirmation email and remains available in your customer account.

Article 8. Shipping and delivery times

We ship within mainland UK. We do not ship to the Channel Islands, as they lie outside the UK VAT area and require customs clearance.

  • Ships within 24 working hours from payment confirmation, for items in stock. Orders confirmed before 15h on a working day ship the same day.
  • Delivery in 1 to 3 business days from when the parcel ships. We ship from the UK.
  • The tracking number is sent by email when the parcel ships.
  • For pre-orders, the parcel ships on the official release day and the 1 to 3 working-day delivery time starts from that moment.

Booster boxes of 36 packs and complete boxes are shipped in double-wall cardboard with padding, so they do not arrive with crushed corners.

Under article 66 bis of the TRLGDCU, we deliver the goods without undue delay and within a maximum of thirty calendar days from the conclusion of the contract, except for pre-orders, whose release date is announced on the product page and accepted when placing the order.

If we failed to meet that delivery obligation, you may ask us to deliver within an additional period appropriate to the circumstances. If we still do not deliver within that additional period, you are entitled to terminate the contract, and we will refund all amounts paid without undue delay.

The times shown are the carrier's and may be extended due to force majeure, strikes, storms or peak periods. If your parcel is delayed, we will let you know.

Article 9. Receipt of the parcel and transfer of risk

Under article 66 ter of the TRLGDCU, the risk of loss or damage passes to you when you take physical possession of the goods, or when a third party designated by you, other than the carrier, does so.

On receipt, check the condition of the parcel before signing. If the packaging is open, punctured, crushed or visibly repacked, record specific reservations on the carrier's delivery note (a generic note such as "subject to inspection" is useless) or refuse the parcel.

Tell us about any damaged, incomplete or non-conforming parcel within 72 hours of delivery, by writing to pkmndistrict.team@proton.me with photos of the closed box, the shipping label, the padding and the products. We reship or refund at our expense. This prompt notice lets us open a claim with the carrier in time, and in no way affects your legal guarantees described in Article 12.

Article 10. Right of withdrawal

Under articles 102 et seq. of the TRLGDCU, you have fourteen calendar days to withdraw from the contract without having to justify your decision and without any penalty, bearing only the direct costs of return.

The period starts on the day you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. If your order is delivered in several parts, the period runs from receipt of the last item. If the last day of the period is not a working day, it is extended to the next working day.

How to withdraw

Inform us of your decision by means of an unequivocal statement before the fourteen-calendar-day period expires:

  • by email to pkmndistrict.team@proton.me, stating your order number and the items concerned;
  • or by post to [[ADDRESS]];
  • or by using the form reproduced in article 19, the use of which is optional.

We acknowledge receipt of your request by email and tell you how to proceed with the return.

Returning the product

You must return the goods to us without undue delay and, in any event, no later than fourteen calendar days from the day you inform us of your decision. Direct return costs are borne by you, unless the product arrived damaged, is not as described or there was a shipping error on our part: in those cases the return is at our expense and we provide you with the label.

Return the product in shipping packaging that protects it, ideally the original shipping box. We recommend a tracked shipment: the burden of proof of return lies with you.

Condition of the returned product

The product must be returned sealed and intact, in its original condition, with the factory seal unbroken.

Under article 108 of the TRLGDCU, you are only liable for any decrease in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics or functioning. For a sealed collectible product, those characteristics are fully shown on the closed packaging: breaking the seal, opening a box or removing a shrink-wrap goes beyond what is necessary and causes the product to lose most of its market value. The refund is then reduced by the amount of that decrease in value, which can reach the full price for an unsealed product. That is why we state throughout the site that an opened product is not taken back.

Refund

We refund all amounts paid, including standard delivery costs where applicable, without undue delay and no later than fourteen calendar days from the date we are informed of your decision. In accordance with Article 107.2 of the TRLGDCU, we may withhold the refund until we have received the goods or until you have supplied proof of having sent them back, whichever is earlier.

The refund is made using the same payment method used for the order, at no cost to you.

Article 11. Exceptions to the right of withdrawal

Article 103 of the TRLGDCU excludes the right of withdrawal in a number of cases. Those that could come close to our catalogue are the following:

  • goods made to your specifications or clearly personalised;
  • goods which, after delivery and by their nature, have become inseparably mixed with other goods;
  • sealed audio or video recordings or sealed computer software that have been unsealed by the consumer after delivery;
  • goods liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery;
  • digital content not supplied on a tangible medium where performance has begun with your prior express consent and your express waiver of the right of withdrawal.

To leave no doubt: the sealed Pokémon Trading Card Game products we sell do not fall under any of these exceptions. The fourteen-calendar-day right of withdrawal applies to our entire catalogue, under the conditions of article 10, including the rule on diminished value.

Article 12. Legal guarantee of conformity

By law, you benefit from the legal guarantee of conformity governed by Articles 114 et seq. of the TRLGDCU. It is free of charge and independent of the right of withdrawal and of any commercial guarantee.

The trader responsible for this guarantee is [[COMPANY NAME]], tax ID (NIF) [[NIF]], with registered address at [[ADDRESS]], email address pkmndistrict.team@proton.me.

What the law says

  • We are liable for any lack of conformity that exists at the time of delivery and becomes apparent within three years from that delivery, in accordance with article 120.1 of the TRLGDCU. For digital content or services, the period is two years.
  • Unless proven otherwise, any lack of conformity that becomes apparent within the two years following delivery are presumed to have existed when the goods were delivered (article 121 of the TRLGDCU). During this period you need to prove nothing other than the existence of the defect.
  • The right to bring a claim expires after five years from when the lack of conformity becomes apparent (article 124 of the TRLGDCU).
  • You can require the goods to be brought into conformity through repair or replacement, and if this is not possible, is disproportionate, is not carried out within a reasonable time or causes you significant inconvenience, you can opt for a price reduction or termination of the contract (Articles 118, 119 and 119 bis of the TRLGDCU).
  • Repair or replacement is free of charge for you and is carried out within a reasonable time from when you inform us of the lack of conformity and without significant inconvenience, taking into account the nature of the goods and the purpose for which you required them.
  • The repaired or replaced goods remain covered for the remaining warranty period, and the period is suspended while the goods are in our possession, as provided by law.
  • The contract cannot be terminated when the lack of conformity is minor, unless we prove otherwise.

How to claim under the guarantee

Write to us at pkmndistrict.team@proton.me with your order number, a description of the problem and photos. We reply within 48 working hours and cover the return costs when the guarantee applies.

A clarification specific to our catalogue: conformity refers to the product as defined by the manufacturer, namely its edition, format, language, completeness and seal. The random contents of a sealed product, the cards pulled and their rarity, are part of the very nature of the product and do not constitute a lack of conformity.

We do not offer any additional commercial guarantee or any paid after-sales service beyond these legal guarantees.

Article 13. Customer service and complaints

Our customer service replies by email within pkmndistrict.team@proton.me, Monday to Friday. We reply within 48 business hours.

You may also send any complaint by post to [[ADDRESS]]. Please include your order number: it saves an exchange of emails.

Complaint forms are available to consumers. You can request them by writing to us and we will send them to you on the same working day.

Article 14. Personal data

The data you provide is necessary to process, deliver and invoice your order and to assist you. Details of the processing, retention periods and your rights are set out in our Privacy policy.

You have the rights of access, rectification, erasure, restriction, objection and portability, which you can exercise by writing to pkmndistrict.team@proton.me. You may also lodge a complaint with the Spanish Data Protection Agency (AEPD), C/ Jorge Juan, 6, 28001 Madrid, www.aepd.es.

Article 15. Complaints and dispute resolution

Before anything else, write to us: most cases are resolved in a single email. If our reply does not satisfy you, you can use the following channels, all free of charge for you:

  • the Municipal Consumer Information Office (OMIC) in your municipality;
  • the consumer affairs directorate of your autonomous community;
  • the relevant Consumer Arbitration Board, within the framework of the Consumer Arbitration System governed by Royal Decree 231/2008. A company's membership of this system is voluntary: if you wish to use it, write to us and we will confirm in writing whether we accept arbitration for your specific case.

Using any of these channels is optional and does not prevent you from going to court afterwards.

Article 16. Cross-border disputes within the European Union

The European online dispute resolution platform created by Regulation (EU) No 524/2013 permanently ceased trading on 20 July 2025, following its repeal by Regulation (EU) 2024/3228. It no longer accepts complaints and there is no longer any active link to it.

For a cross-border dispute within the European Union, you can contact the European Consumer Centre in Spain, www.cec.consumo.gob.es.

Article 17. Force majeure

Neither party is liable for a failure to perform due to unforeseeable circumstances or force majeure within the meaning of Article 1105 of the Spanish Civil Code. If the impediment is temporary, performance is suspended for as long as necessary. If it is permanent, the contract is terminated and we refund the amounts paid.

Article 18. Applicable law and jurisdiction

These terms are governed by Spanish law. The language of the contract is Spanish.

In the event of a dispute, an amicable solution will be sought first. Failing agreement, jurisdiction lies with the courts and tribunals of the consumer's home, in accordance with article 90.2 of the TRLGDCU, which deems unfair any clause submitting the contract to a different jurisdiction.

If any clause of these terms were declared void or unenforceable, the others would remain in force.

Article 19. Withdrawal form

This form is reproduced in accordance with annex B of the TRLGDCU. Its use is optional: a clear email is enough.
