You have fourteen calendar days to withdraw from your purchase without having to justify your decision. The only condition is that the product comes back sealed and intact. An opened product is not taken back, and we explain why below.
This right is governed by Articles 102 et seq. of Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Protection of Consumers and Users (TRLGDCU).
1. The time limit
The fourteen-calendar-day period starts on the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. If your order is delivered in several parcels, the period runs from receipt of the last one. If the last day of the period is a non-working day, it is extended to the next working day.
The product does not need to have been released yet: if you want to cancel an order before it ships, just tell us by email.
2. How to notify us
Inform us of your decision by means of an unequivocal statement, before the deadline expires:
- by email to pkmndistrict.team@proton.me, stating your order number and the items concerned;
- or by post to [[ADDRESS]];
- or by using the form reproduced at the end of this page, the use of which is optional.
We acknowledge receipt of your request by email within 48 working hours and give you the return address and the steps to follow. To meet the deadline, it is enough for your notice to be sent before it expires.
3. Returning the product
You must return the goods to us without undue delay and, in any event, no later than fourteen calendar days from when you inform us of your decision.
Direct return costs are borne by you, in accordance with Article 108.2 of the TRLGDCU, of which you are informed on this page and before confirming the order. The exceptions are cases where the product arrived damaged, is not as described or there was a shipping error on our part: the return is then at our expense and we provide you with the label.
Return the product in protective shipping packaging, ideally the original shipping box, and with tracking: the burden of proving the return is on you.
4. What condition it must be returned in
The product must be returned sealed and intact, in its original condition, with the factory seal unbroken.
In accordance with Article 108.1 of the TRLGDCU, you are only liable for the decrease in value of the goods resulting from handling other than what is necessary to establish their nature, characteristics or functioning.
For a sealed collectible product, these characteristics appear in full on the closed packaging: the edition, format, contents announced by the manufacturer, language and release date are printed on the outside. Breaking the seal, opening a box or removing a shrink-wrap goes beyond what is necessary to establish what it is and makes the product lose most of its market value, because it can no longer be resold as sealed.
The refund is then reduced by the amount of that diminished value, which for an unsealed product can reach the full price. That is why we say it the same way on every page of the site: an opened product is not taken back.
Torn shrink wrap, an opened box, an unpacked collection or a broken seal all fall into this category. An opened shipping box, on the other hand, poses no problem: what counts is the product's seal.
5. Your refund
We refund all amounts paid, including standard delivery costs where applicable, without undue delay and no later than fourteen calendar days from the date we are informed of your decision, in accordance with Article 107.1 of the TRLGDCU.
In accordance with Article 107.2, we may withhold the refund until we have received the goods or until you have supplied proof of having sent them back, whichever is earlier.
If you chose a delivery method other than the cheapest one we offer, we are not required to refund the additional costs of that method.
The refund is made using the same payment method as the order, at no cost to you. Depending on your bank, allow 2 to 5 additional business days for it to appear in your account.
6. Exceptions
Article 103 of the TRLGDCU excludes the right of withdrawal in certain cases, including goods made to the consumer's specifications, goods that are inseparably mixed with other items after delivery, sealed recordings or computer software that have been unsealed after delivery, goods liable to deteriorate rapidly, and sealed goods unsuitable for return for health or hygiene reasons that have been unsealed.
To leave no doubt: the sealed Pokémon Trading Card Game products we sell do not fall under any of these exceptions. The right of withdrawal applies to our entire catalogue, including pre-orders, under the conditions described above and subject to the rule on diminished value in section 4.
7. What withdrawal does not cover
Withdrawal is for changing your mind. If the problem is something else, there is a different route, and it is usually free for you:
- Parcel damaged in transit or shipping error: let us know within 72 hours of delivery with photos. The return is at our expense. Full details are in Shipping and returns.
- Non-conforming or defective product: the legal guarantee of conformity of three years from delivery, with a presumption in your favour during the first two years. It is set out in our General terms of sale.
- A disappointing opening: the contents of a sealed product are random and determined by the manufacturer. This is not a lack of conformity and does not entitle you to a return.
8. Withdrawal form
This form is reproduced in accordance with annex B of the TRLGDCU. Its use is optional: a clear email is enough.
